A Living Will is the commonly used term for a directive to physicians regarding the withholding of medical procedures under certain circumstances. A Living Will is a document that lets family members and attending medical staff know the type of care a person does or does not want to receive in the event he or she becomes unable to personally express his or her desires due to incapacity or incompetency. The Living Will sets forth ones instructions regarding the withholding of medical care which would otherwise keep one’s life being sustained by artificial means. If it is your desire that such care not be rendered in the event of a terminal condition, it is important that the Living Will be properly executed while you are still competent to express your wishes. If a Living Will is not presented to your family and/or medical staff attending to, complicated and expensive court proceedings regarding the type of care to be provided or withheld may be required.
